The first batch of 18 products with three guarantees: bicycles, color TVs, black and white TVs, home video recorders, video cameras, recorders, electronic keyboards, household refrigerators, washing machines, fans, microwave ovens, vacuum cleaners, home air conditioners, and range hoods , Gas water heater, sewing machine, clock, motorcycle.

It is specified in the new Three Guarantees that the catalog of products that implement the Three Guarantees will be determined and adjusted by the relevant departments of the State Council.

With the addition of five new products such as flat-screen TVs, mobile phones, fixed phones, microcomputers, and home audio-visual products, a total of 23 products in China have been included in the "three guarantees" policy.

Imported products also apply to the new three guarantees.

For products that are not included in the new Three Guarantees, quality problems have occurred. Sellers are responsible for repairing, replacing, returning, and compensating for the losses caused by them.


Three Guarantees Liability


Consumers have the right to require distributors to assume the Three Guarantees responsibility for products purchased in the following situations.

1. Does not have the use performance that the product should have, without prior description;

2. Does not meet the requirements of the product standards explicitly used;

3. Does not meet the quality conditions indicated by product descriptions, physical samples, etc .;

4. The product is not qualified after being inspected by statutory departments such as the technical supervision administrative department;

5. The product is not working properly after two repairs.


Three Guarantees Time


1. "7 days" stipulates that within 7 days from the date of sale of the product, a performance failure occurs, and consumers can choose to return, exchange or repair.

2. "15 days" stipulates that within 15 days from the date of sale of the product, a performance failure occurs, and consumers can choose to exchange or repair.

3. The "three guarantees validity period" stipulates that the "three guarantees" validity period is calculated from the date of issue of the invoice. In the first batch of 18 products released by the state to implement the "three guarantees", such as color TVs, plasma TVs, and LCD TVs, the "three guarantees" are valid for one year. The main components are one year (main board, LCD screen, Backlight module) for three years. If the product is repaired twice within the validity period of the "Three Guarantees" and still cannot be used normally, consumers can replace the products of the same model and specifications with the repair records and certificates, or return the products in accordance with relevant regulations. And no spare parts time. The validity period of the "three guarantees" after replacement is recalculated from the date of replacement.

4. "90 days" and "30 days": During the validity period of the "three guarantees", because the manufacturer has not supplied spare parts, it has not been repaired for more than 90 days since the date of repair, the repairer should indicate in the repair status, With this, sellers can exchange products of the same model and specifications for consumers free of charge. If the repairer makes repairs for more than 30 days, he or she will replace the product of the same model and specification for the consumer free of charge, and the repairer will bear the cost.

5. "30 days" and "5 years": the repairer shall ensure that the repaired product can be used normally for more than 30 days, and the manufacturer shall ensure that the parts that meet the technical requirements will continue to be supplied within 5 years after the product is discontinued.

6. The new Three Guarantees regulations came into effect on August 25, 1995. Consumers have the right to require sellers, repairers, and producers to assume responsibility for the Three Guarantees for products purchased in the Three Guarantees catalog after that date. Products purchased before August 25, 1995 can only continue to be implemented in accordance with the "Three Guarantees for Certain Domestic Appliances" issued in 1986.

Three Guarantees Obligations

Obligations of sellers

(1) Those who cannot guarantee the implementation of the three guarantees shall not sell the products listed in the catalog;

(2) maintaining the quality of the products sold;

(3) Implementing the purchase inspection and acceptance system and failing to comply with the legal labeling requirements shall not allow sales;

(4) When the product is sold, it should be inspected out of the box, properly debugged, introduced the use and maintenance items, the Three Guarantees method and the repair unit, and provided a valid invoice and a Three Guarantees certificate.

(5) Properly handle consumer inquiries and complaints and provide services.

Duties of the repairer

(1) undertaking repair service business;

(2) Maintain the reputation of sellers and producers, and shall not use components and spare parts that do not conform to the technical requirements of the product. Carefully record the quality of the fault and the product after repair to ensure that the repaired product can be used normally for more than 30 days;

(3) Ensure that all repair costs and repair parts are used for repairs. Accept the supervision and inspection of sellers and producers;

(4) to bear the responsibility and loss caused by its own repair errors;

(5) Accept consumers' inquiries about the quality of product repairs.

Obligations of producers

(I) Clarify the Three Guarantees method. If the producer sets up or designates a repair unit on his own, he must provide the consumer with a three-guarantee certificate, a list of repair units, an address, and a telephone number with the product;

(2) Provide repair technical materials, qualified repair parts, responsible for training, and provide repair costs to the seller and repairer in charge of repair. Guarantee to continue to provide technical parts and components within 5 years after the product is discontinued;

(3) Properly handle consumers' direct or indirect inquiries and provide services.

After the implementation of the Three Guarantees Law, according to national regulations, the warranty period for the entire PC is 1 year, and the main components are 2 years. The main components include the CPU, motherboard, memory, graphics card, hard disk, and power supply.

If you carefully read the specific content of the Three Guarantees Law, you will find that the Three Guarantees regulations are very helpful for buying branded machines, and there are not many regulations on compatible machines. The Three Guarantees method specifies the mainframe, and the peripheral products can be returned and exchanged within 7 days if there is a problem within 15 days. There is no corresponding provision for the optional parts (also known as compatible machines). If the main unit and peripherals cannot be used normally after two repairs, the seller will freely exchange products of the same model and specifications for consumers. During the three-guarantee period of the entire machine, if the seller requires neither a product of the same model and specifications, nor a product of the same brand that is not less than the performance of the original product, the consumer should return the product for free, and Refund the payment once at the invoice price.

However, the provisions of Article 15 of the Three Guarantees Law are not very good. If the mainframe or peripherals purchased by the consumer cannot be used normally after two repairs, the replacement is required, and the depreciation fee needs to be charged at the prescribed depreciation rate. The calculation date of depreciation fee is from the date of issue of the invoice to the date of return, which shall be deducted from the repair occupation and the time to be repaired. The national depreciation is 0.25% per day. If your machine has problems after 400 days of purchase, it has not been more than two years. At this time, if you calculate the depreciation, it is no longer valuable, but if you refund the invoice price, it is very Cost-effective, even after buying a high-performance host, there is still money left.

In practical applications, for the sake of their own interests, the dealers are exploring the legal gaps. In addition, consumers do not know the specific contents of the Three Guarantees, not to mention that some personnel in charge of 315 do not know the details of the Three Guarantees. Content, want to return the money to clear, it is almost impossible.

2. Options

Before the implementation of the Three Guarantees, the motherboard, memory, hard disks, graphics cards, etc. had a warranty of three years, but since the implementation of the Three Guarantees, the warranty period has been changed to 1 year. The state stipulates that it should be replaced within one year, and the warranty period needs to be recalculated after the replacement.

Here is a place where ambiguity easily occurs. That is, I bought an assembly machine at a computer company. If quality problems occur and two consecutive repairs still fail to work normally, this is the merchant who will not refund you. For the whole machine, only the corresponding faulty parts will be replaced or repaired. Because what we all think of as a "complete machine" is not a complete machine in the legal sense, but an option, but the option we purchased is installed together with the computer company, and finally the entire machine is The form was taken home. Therefore, the three packs of the "compatible machine" that we bought at the computer company can only be implemented in accordance with the three packs of the "optional parts". Failure, the seller should be responsible for the exchange of new options for consumers free of charge. If the option cannot be used normally after the replacement of the option twice, the seller shall be responsible for returning the product free of charge to the consumer and refunding the payment once at the price of the invoice.

One thing is good. Regardless of whether it is a complete machine or an option, as long as it is replaced with a new product, the validity period of its three guarantees will be recalculated from the date of replacement.
